From 26 October 2024, employers will be under a new positive duty to take reasonable steps to prevent sexual harassment of their workers.
Failing to comply with this new duty can be costly with the Tribunal being given the power to uplift any compensation awarded to employees for sexual harassment claims, by up to 25%. The EHRC can also take enforcement action against the employer.
